U.S. House Passes H.R. 5 to Reauthorize NCLB…Common Core embedded

The Elementary and Secondary Education Act of 1965 (ESEA) was reauthorized as the No Child Left Behind Act 2001, all of which is unconstitutional. NCLB is being authorized over widespread protests by parents, teachers, policy experts, and activists.

The House version, Student Success Act (SSA – H.R. 5), was passed on July 8th with a 218-213 vote. Only Republicans voted for the bill with all Democrats and 27 Republicans voting against it.

Federal Control Tightened

  • Federal government must approve state plans for alignment to the “college-and-career-ready” standards, code for Common Core
  • Zeldin (R-NY) – Amendment 53 allow states to withdraw from Common Core but symbolic because HR 5 requires states to align their standards, assessments, and accountability systems to Common Core
  • No enforcement mechanism to prohibit the feds from interfering with state standards or tests such as Common Core
  • Consolidates federal programs instead of eliminating them

Early Childhood

Testing/Assessments

  • Continues federal annual high-stakes testing with teach to the test environment
  • Continues psychological profiling and data mining
  • Requires that all states have 95% participation in state assessments and that test scores be used to rate the schools
  • Salmon (R-AZ) 846 – amendment allows parental opt out without students being counted against the 95% participation rate

Psychological Profiling/Manipulation

  • Lifts the ban on attitudinal testing in federally mandated statewide tests
  • Requires particular tests that are very expensive and include psychological data collection and profiling
  • Title I provides funding for all sorts of health and social services, including mental health
  • Allows the National Assessment of Educational Progress (NAEP) to implement its planned and unconstitutional affective probing of psychological traits.

Shorter Period to Reauthorization

  • Rokita (R-IN) – amendment to set next reauthorization in 2019

On July 16th, the Senate passed its own version, Every Child Achieves Act S.1177. H.R. 5 will have to be reconciled with S.1177, which is the worse of the two bills. The final version will then be sent to President Obama for his signature. Obama threatened veto of H.R. 5 so if he signs the final version, we can be certain that it allows for more government control of education and less for parental and local control.
