Federal lawsuit accuses Willis ISD of ignoring classroom sex

A federal lawsuit accuses a Willis teacher of having oral sex in a classroom with a female student last year while school officials ignored what was going on.

Named as defendant in the federal lawsuit is the Willis Independent School District, where the teacher, Bruce Kincaide, 27, was an assistant girls basketball coach at Willis High School. He resigned in February 2012 when questioned by school administrators about the allegations.

The student, K.M., alleges that Kincaide befriended her through text messages, phone calls and emails, and eventually called her out of class to visit him in his classroom during his planning period, according to the lawsuit.

She was a junior during the 2010-11 school year and a senior during the 2011-12 school year, when Kincaide was assistant coach.

“During summer between (K.M.’s) junior and senior years, Mr. Kincaide became more and more aggressive in his actions towards (K.M.): for example, he was writing suggestive communications, making physical gestures toward (K.M.) and suggesting that he ‘liked’ her in a physical manner and that he was even having sexually suggestive dreams about her,” the lawsuit states.

On several occasions inside the classroom, Kincaide “would kiss and grope” the girl, who “did not know how to respond to the advances, and was afraid to tell anyone of the advances,” according to the lawsuit.

“As the semester progressed, and the calls to have (K.M.) leave (her teacher’s) class increased, Mr. Kincaide began demanding oral sex be performed by (K.M.) in Mr. Kincaide’s classroom following his visual exploration of porn sites on the school’s computer,” according to the lawsuit.

The plaintiff alleges that school officials “turned a blind eye to what was going on” with Kincaide, who “became extremely possessive of (K.M.)” and refused to allow other coaches to work with her during basketball practice.

In December 2011, Kincaide told the girl to come to his house, where he allegedly had sex with her against her will, according to the lawsuit. Kincaide has been charged with improper relationship between a student and educator, court records show.

The school district issued a statement regarding the case.

“I want to assure every parent, grandparent and every member of the Willis ISD community that your children will be nurtured and safe when they are in school,” then-Willis ISD Superintendent Bret Jimerson stated in a press release. “We are both outraged and deeply saddened by these circumstances.

“That’s why the District responded aggressively to investigate this matter, and even since the teacher resigned, we have worked diligently to cooperate with law enforcement authorities during the criminal investigation,” Jimerson stated.

Jimerson was replaced as Willis ISD superintendent by Tim Harkrider on July 8.

Willis is 48 miles north of Houston.
