“Hold Straus and Cook Responsible for Squelching Student Privacy Laws in Texas”

Texas Speaker of the House Joe Straus colluded with Rep. Byron Cook to keep the student privacy bills (SB 3 authored by Sen. Lois Kolkhorst and HB 46 authored by Rep. Ron Simmons) from ever getting out of Rep. Cook’s State Affairs Committee during the Special Session. Therefore, during the Special Session, the Texas House never had a chance to vote on this issue. During the Regular Session, there was a committee hearing; but there never was a full floor vote.


Bottom line: Two people (Straus/Cook) kept the members of the Texas House from ever having a chance to vote on the Student Privacy Laws.


“Texas Values Action released a new survey (http://tinyurl.com/ybqr8aaj) of over 1,500 Texas Republican primary voters this week showing nearly 80% of voters support privacy legislation and will cast their primary vote accordingly.”


Unexpectedly on 8.15.17, Rep. Dan Huberty called a sine die to the Special Session over outcries from the other members.  The Special Session ended a day early.  Gov. Abbott is considering calling a Second Special Session, but it will take a miracle for this to happen.




If the Texas Legislature decides to “kick the can” back to the locals, the issue will play out in every school district in Texas where the harsh realities, the loss of students’ individual privacy, and the lawsuits will be sure to follow. Look what a terrible situation has arisen in Boyertown Area School District in Pennsylvania where students have been told to “tolerate” undressing with members of the opposite sex – even with those who decide on their own gender.  


Can you imagine being a self-conscious 13-year old teenage boy who is in a state of undress in a school locker room. He looks over and sees a girl looking at him while she has no clothes on? 


Can you picture yourself being a 14 year-old girl who is already self-conscious about being a little overweight and has not developed a bustline yet?  She looks over and sees a teenage boy standing there looking at her while he has no gym shorts on.


These are the scenarios that are playing out across our country and that could well play out in every school district in Texas (and in other states) if the legislatures fail to pass Student Privacy laws.

Texans have 5 days left to keep their public school children (i.e., public and charter schools) from showering, dressing, and using the bathroom right next to children of the opposite sex.  If the Texas Legislature does not pass the Student Privacy Laws by this Wednesday, the public will be left to fight this battle in every public school district in Texas.  Meanwhile during the time that parents are having to rake up enough money to hire lawyers to battle this issue, their children will be experiencing daily exposure to children of the opposite sex in a state of undress.  Children cannot “unsee” what they have seen, and their protective naiveté will have been shattered for the rest of their lives.
