ACTION STEP:  Now it will be up to all of us in Texas to tell our school superintendents to vote for the UIL ballot measure that makes the birth certificate a determination for gender.

The Texas UIL Legislative Council just approved a binding referendum ballot measure to add a provision to the UIL Constitution and Contest Rules specifying how a student’s gender is to be determined.  The binding referendum ballot measure is to be voted on by superintendents from districts and charters that participate in UIL activities and will go into effect on 8.1.16. The resolution says:

“Gender shall be determined based on a student’s birth certificate. In cases where a student’s birth certificate is unavailable, other similar government documents used for the purpose of identification may be substituted.”

UIL staffers stated that it has been a long-standing procedure to require birth certificates to determine a student’s gender and that putting this wording into the UIL Constitution and Contest Rule book will formalize that procedure.

Side note:  The head of the transgender advocacy group (TransAthlete.com) has called the measure “a horrible policy because categorizing transgender student athletes by their birth certificates is among the least inclusive policies at the high-school level.” From this statement, we can be assured that the TransAthlete organization joined with other LGBTQQ groups will try to put pressure on superintendents to vote against the “birth certificate” measure.

The UIL is the largest inter-school organization of its kind and provides leadership and guidance over educational extracurricular academic, athletic, and music contests held in Texas.
